Whenever you have an establishment that allows public access you have to be worried about the possibility that someone will be injured on your property. If someone is injured on commercial property they can hold the owner of the property liable for their medical expenses, and in some cases, their pain and suffering associated with the injury. Some establishments are cautious about using fold down seats because they fear that someone will be injured by them.
Fold down seats do have a tendency to fold back up when there is not sufficient weight in them to activate the release mechanisms. These seats are designed to be let down and the weight of the person in the seat will keep the spring loaded mechanism from folding back up. If the person sitting in the chair is a small child then their weight may not be sufficient to keep the chair from folding back up.
The return to folded position is a slow one. The fold down seats does not spring back quickly. They slowly revert back to the position they were in. When a child is sitting in the seat and the chair folds back up there is very little chance that the child will be injured during the process.
Fold down seats could have the ability to pinch someone on the arm or the leg when they close. This pinching will more than likely not be a serious injury, but the possibility that the skin on the person's arm or leg could be broken is high. No business wants someone to get any type of injury while on their premises.
The business can be sued if there is an injury, but more importantly the person that was injured will tell their friends of the incident and they may stop other people from coming to the business. Luckily folding chairs are not potentially deadly and the majority of people who get their hand caught in them feel like it was their own fault.
The main safety issue with these types of seats is the possibility that one of the supports will become compromised and the seats will collapse. When something like this occurs and people fall they can be injured severely.
The people would not fall from a very tall height, but the fact that they would fall and strike portions of their body on hard pieces of the seating system could cause cuts, bruises, and contusions. Other people falling on them could also add to the injuries that occur when one of the systems collapses.
To prevent this event the owner of the establishment should perform regular inspections of the seating system to ascertain if any of the supports are becoming weakened. Too much weight in the chairs can bend bars and weaken supports over time. These supports can also be compromised when people allow children to rough-house in the seats. The added stress on the support brackets can cause them to wear into.
